These Terms of Service ("Terms") govern your use of the Hydrate America website at hydrateamerica.com and the services we provide. By using our website, submitting our lead capture form, or becoming a customer, you agree to these Terms. If you do not agree, please do not use our website or services.
About us
Hydrate America is a water dispenser rental service operating in South Florida. We install and maintain premium Borg & Overström B4 water dispensers in small business locations on a monthly subscription basis.
Service area
Our service is currently available only to businesses located in Palm Beach County, Broward County, and Miami-Dade County, Florida. We may expand to other areas in the future. We are not obligated to provide service outside our current area.
Pricing and fees
Our standard monthly service rate is $99/month. This rate covers the rental of the dispenser, all filter replacements, scheduled maintenance, and service visits.
A one-time installation fee of $199 is charged at the time of installation. This fee covers the initial setup, delivery, and connection to your existing water line.
Promotional pricing, including any "limited time" rates advertised on our website, is valid for new customers only and may change without notice. We reserve the right to change our pricing at any time, but any changes will not affect existing customers within their current service period without prior notice.
Sales tax, where applicable, is not included in the rates shown and will be added to your invoice.
Comparison claims
Our website includes comparisons between our service and the cost of bottled alkaline water. These comparisons are based on average retail pricing of leading alkaline water brands and on typical small-business water usage. Actual savings will vary based on your specific water consumption and the prices of products you would otherwise purchase. The comparisons are for illustrative purposes and do not constitute a guarantee of savings.
No long-term contract
Our service does not require a long-term contract. You may cancel service at any time with reasonable notice. Upon cancellation, we will arrange to remove the dispenser from your location. We may charge a removal or retrieval fee if applicable, which will be disclosed to you at the time of cancellation.
Service and maintenance
We provide all scheduled maintenance, filter replacements, and repair service as part of the monthly fee. If the dispenser malfunctions through normal use, we will repair or replace it at no additional cost. We do not cover damage caused by misuse, abuse, vandalism, or unauthorized modification of the equipment.
Service visits will be scheduled at mutually convenient times during normal business hours.
Customer responsibilities
As a customer, you agree to:
- Provide a suitable location for the dispenser, including access to a cold water supply and a standard electrical outlet
- Use the dispenser only for its intended purpose
- Allow our technicians reasonable access for installation, maintenance, and service visits
- Notify us promptly if the dispenser malfunctions or appears damaged
- Pay monthly invoices on time
Equipment ownership
The water dispenser, floor stand, and any related equipment remain the property of Hydrate America at all times. You are renting the equipment under a monthly service agreement; you do not own it. Upon cancellation of service, the equipment must be returned to us.
Limitation of liability
To the fullest extent permitted by law, Hydrate America's total liability to you for any claim arising from or related to our service is limited to the amount you paid us in the three months preceding the claim. We are not liable for any indirect, incidental, consequential, or punitive damages, including but not limited to lost profits, business interruption, or property damage beyond the limits described above.
Nothing in these Terms limits liability that cannot legally be limited or excluded.
Website use
Our website is provided for informational purposes. You agree not to use our website in any way that could damage, disable, overburden, or impair the site, or interfere with anyone else's use of it. You agree not to attempt to gain unauthorized access to any part of the site.
The Hydrate America name, logo, and all original content on this website are our property. Borg & Overström is a trademark of its respective owner.
Changes to these Terms
We may update these Terms from time to time. Changes will be posted on this page with an updated effective date. Continued use of our website or service after changes constitutes acceptance of the updated Terms.
Governing law
These Terms are governed by the laws of the State of Florida, without regard to its conflict of law principles. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Palm Beach County, Florida, and you consent to the jurisdiction of those courts.
